This Terms of Use Agreement (“Agreement”) is a legally binding contract between Pixiflow (“Pixiflow”, “we”, “us”, or “our”) and you (“Client”, “you”), whether acting as an individual or on behalf of a legal entity.
By accessing or using https://pixiflow.pro (the “Website”) and related services, you agree to these Terms. If you do not agree, you must stop using the Website immediately.
Any outstanding payment obligations remain valid even after termination of use.
1.Intellectual Property
All materials on the Website—including text, graphics, code, designs, logos, and media (“Content”)—are owned by Pixiflow or its licensors and are protected under applicable intellectual property laws, including EU and Polish regulations.
You may use the Website only for its intended purposes. Any reproduction, distribution, modification, or commercial use of Content without prior written consent is prohibited.
2.Ownership of Work
All final design work and source files created for the Client (“Projects”) become the Client’s property upon full payment.
Pixiflow assigns all intellectual property rights in such Projects to the Client to the fullest extent permitted by law.
You confirm that any materials you provide:
- are owned by you, or
- you have the legal right to use them
Pixiflow is not responsible for any infringement caused by Client-provided materials.
Pixiflow may showcase completed work for portfolio and marketing purposes unless a written non-disclosure agreement (NDA) is in place.
3.Third-Party Fonts and Assets
If a Project includes third-party fonts or assets requiring licenses:
- Pixiflow will inform you
- You are responsible for obtaining and maintaining those licenses
Pixiflow is not liable for any consequences resulting from failure to obtain proper licenses.
4.User Representations
By using the Website, you confirm that:
- You have the legal capacity to enter into this Agreement
- You are at least 18 years old or of legal age in your jurisdiction
- You will not use automated tools or bots to access the service
- You will not use the Website for illegal or unauthorized purposes
- You will comply with all applicable laws, including EU and Polish law
5.Prohibited Activities
You agree not to:
- Use the Website for unlawful purposes
- Copy, scrape, or extract data without permission
- Interfere with security features or system integrity
- Upload malicious software or harmful content
- Misrepresent yourself or mislead others
- Harass or abuse Pixiflow staff
- Use the service to compete directly with Pixiflow
6.Feedback
Any feedback, suggestions, or ideas you provide may be used by Pixiflow without restriction, compensation, or obligation.
7.Service Management
Pixiflow reserves the right to:
- Monitor use of the Website
- Restrict or terminate access if Terms are violated
- Take legal action when necessary
These actions may be taken without prior notice where permitted by law.
8.Privacy and Data Protection (GDPR)
Pixiflow processes personal data in accordance with:
- Regulation (EU) 2016/679 (GDPR)
- Applicable Polish data protection laws
By using the Website, you acknowledge that:
- Your data may be processed for service delivery, communication, and legal compliance
- You have rights under GDPR, including access, rectification, erasure, restriction, and data portability

Pixiflow does not knowingly collect data from individuals under 16 years of age.
9.Refund Policy
Refunds are considered on a case-by-case basis, in accordance with applicable consumer protection laws.
If a refund is granted:
- All rights to work created during the refunded period revert to Pixiflow
- You may not use any delivered materials
- Payment processing fees (e.g., Stripe) may be non-refundable where legally permitted
Nothing in this section limits mandatory consumer rights under EU law.
10.Changes to Services
Pixiflow may modify or discontinue services at any time.
Where required by law, users will be informed of significant changes.
11.Service Availability
Pixiflow does not guarantee uninterrupted or error-free access.
We are not liable for:
- downtime
- technical failures
- interruptions beyond our control
12.Governing Law
This Agreement is governed by the laws of Poland, without regard to conflict of law principles.
13.Dispute Resolution
Any disputes shall be subject to the jurisdiction of Polish courts.
If you are a consumer in the EU, you may also:
- use local consumer protection mechanisms
- access the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
14.Disclaimer
The Website and services are provided “as is” and “as available”.
Pixiflow makes no guarantees regarding:
- accuracy
- reliability
- availability
To the fullest extent permitted by law, all warranties are excluded.
15.Limitation of Liability
To the extent permitted by law, Pixiflow is not liable for:
- indirect or consequential damages
- loss of profits, data, or business opportunities
Nothing in this section excludes liability where prohibited by law (e.g., intentional misconduct or consumer rights protections).
You agree to indemnify Pixiflow against claims arising from:
- your use of the service
- your violation of these Terms
- your infringement of third-party rights
16.User Data
You are responsible for all data you submit.
Pixiflow is not responsible for data loss unless required by law.
17.Electronic Communication
You agree that:
- communication may be electronic
- contracts and approvals may be digital
- electronic signatures are legally valid
18.Licensing Responsibility
You are solely responsible for ensuring that all content you use:
- is properly licensed
- does not infringe third-party rights
Pixiflow licenses are not transferred unless explicitly stated.
19.Portfolio Rights
Pixiflow may display completed work publicly unless restricted by a written NDA.
20.Miscellaneous
These Terms constitute the entire agreement between you and Pixiflow.
If any provision is found invalid, the remainder remains enforceable.
This Agreement does not create a partnership, employment, or agency relationship.
